to 2TANG TEA! Thank you for visiting our website. This page, together with our
guidelines and other documents explain to you the terms and conditions (“Terms
and Conditions”) regarding how to use our Platform (as on) either as a guest or
as a Customer. Please read these Terms and Conditions before you order Products
from the Platform. By using our Platform you have agreed to support these Terms
and Conditions and to comply with them. Please visit this page periodically to
be aware of any changes we make to our Terms and Conditions.
1.
About Us
We
are PT Duta Serpack Inti and do our sales through www.2tangtea.co.id (“2TANG”).
These
Terms and Conditions are our copyright which is protected by intellectual
property. Its use by any third party, including excerpts of these Terms and
Conditions for commercial purposes related to the offer of goods and/or
services is not permitted. Violations may be subject to legal action.\
2.
Definition
In
these Terms and Conditions:
- "Account"
means the 2TANG Account you need to register on our Platform if you wish to
place an Order;
- "Working
Day" means days from 8.00 am to 5.00 pm in Jakarta, otherwise Saturday,
Sunday or National Holiday;
- "Order
Confirmation" means our email to you in the form of confirmation of your Order.
"Contract" means an Order of 1 or more Products in accordance with
the Terms and conditions.
- "Customer"
means any person who places an Order on the Platform;
- "Order"
means an order that you place on the Platform to purchase Products from us;
- “Platform”
means the 2TANG App and Site and the sites that we may own and maintain from
time to time, each of which will be referred to as a “Platform”; “Site” means
the 2TANG site accessible through www.2tangtea.com ;"You " means
Customer or guest; References to "section" are articles in these
Terms and Conditions;
- Headings
are for convenience of reference only and will not affect interpretation or the
Terms and Conditions;
- Words
in the singular must include the plural and vice versa. Words in the form of
gender consist of any gender and references to people including individuals,
companies, corporations, or partnerships;
- Reference
to "include" or "include" or similar words or expressions,
means without limitation.
3.
Requirements
To
place an Order at 2TANG you must be over 18 (eighteen) years of age. If you are
under the age of 18 (eighteen), you may place an Order at 2TANG TEA with the
assistance of your parent or guardian.
4.
Prohibition
You
must not abuse our Platform. You are prohibited from using any automation
system or software to extract data from our Platform for any purpose. You are
prohibited from committing or supporting criminal acts, sending or distributing
viruses including but not limited to Trojan horses, worms, logic bombs or
sending other material to the Platform that is harmful, technologically
destructive, violates trust or in any way that is offensive or harassing; hack,
corrupt data; cause disturbance to other users; violate the ownership rights of
any party; send unsolicited advertising or promotional materials; or attempt to
affect the performance or functionality of any computer facility or access to
the Platform as a whole. Any violation of this provision is a criminal offense
under Law Number 11 of 2008 concerning Internet and Electronic Transactions
(ITE), Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008
concerning Information and Electronic Transactions (ITE). and other relevant
laws and regulations. If this happens, 2TANG will report the violation to the
law enforcement authorities and appropriate legal action will be taken.
5.
Entire Agreement
The
Terms and Conditions apply to your use of the Platform and to all Orders and
Contracts made or to be entered into by us for the sale and supply of Products.
The Terms and Conditions constitute the entire agreement between you and 2TANG
and supersede any and all prior agreements between us.
You
acknowledge that in this Contract, neither you nor we rely on any
representations, representations or promises given by the other party or
implied by words or written statements between you and us before the Terms and
Conditions apply, except as expressly stated in the Terms and Conditions.
Provision.
6.
Terms of Sale
1 Registration
- To
place an Order, you must create an Account on the Platform. You need to enter
correct and accurate information. You also need to ensure that your information
is up-to-date and inform us of any changes to the way you use the features on
the Platform.
- You
are prohibited from abusing the Platform by creating multiple user accounts.
2 Contract Forming
- The
information set out in the Terms and Conditions and the details contained in
this Platform does not constitute a sales offer but for protection purposes.
Contracts for Products will only occur between you and us when we deliver
Products to your address.
- To
place an Order, you will be asked to follow the online shopping process on the
Platform. After that you will receive a valid Order Confirmation as
confirmation of your Order.
- Orders
will only be deemed to have been received by us once the Order has been shipped
to the shipping address you have provided.
- The
contract only relates to the Products we deliver to you. If your Order consists
of more than one Product, the Products may be delivered to You in separate
packages and at separate times.
7.
Price and Payment
We
make best efforts to ensure all details, descriptions and prices appearing on
this Platform are accurate, however there are circumstances where errors may
occur. If we discover an error in the price of a Product that you have ordered,
we will inform you of this as soon as possible and you may choose to reconfirm
your Order at the correct price or cancel your Order. If we are unable to
contact you, we will cancel your Order. If you cancel before the Order is
shipped and you have made payment, you will receive a full refund.
- Prices
listed are inclusive of tax and are in Indonesian Rupiah. Shipping charges will
be charged as an additional fee if applicable; the surcharge is clearly
displayed and included in the 'Final Amount'.
- We
are under no obligation to fulfill your Order if the price listed on this
Platform is incorrect (even after your Order has been acknowledged by us).
- You
can make payments using one of our payment partners registered on our platform
or make cash on delivery or cash on delivery. You may also pay all or part of
the price of your Order using an e-gift card, wallet credit or promotional
voucher.
- E-gift
cards and promotional vouchers can only be entered at the online check-out
page.
- To
minimize the risk of unauthorized access, we encrypt your card data. Once we
receive your Order we will ask for a pre-authorization on your card to ensure
funds are available to complete the transaction. Orders will only be confirmed
once this pre-authorization check is complete. Your card will be debited after
we have sent the Order Confirmation. Validation and validation checks on the
card will be carried out by the card issuer. If we do not receive the required
authorization, we are not responsible for delays or non-delivery.
- After
authorizing the payment, clicking the "Order Now" button means that
you confirm that the card belongs to you or that you are the legal holder of
the e-gift card or promotional voucher and have sufficient funds to pay the Product
fee.
8.
Wrong Order
If
you become aware of an error in the Order after you have placed an Order on the
Platform, please contact customer@2tang.com as soon as possible. We will try
our best to process your request.
9.
Order Rejection
We
reserve the right to remove Products from the Platform at any time and/or
delete or modify all materials or content on this Platform. We will use our
best efforts to always process all Orders but there may be special
circumstances where we may need to refuse to process an Order after we have
sent an Order Confirmation, which we reserve the right to do at any time, at
our discretion. If we cancel your Order and you have made payment for the
Order, the payment amount will be fully refunded to you. We will not be liable
to you or any other third party regarding the reason we withdraw a Product from
this Platform, whether it has been sold or not, removing or editing material or
content on this Platform or for refusing to process or accept an Order.
10.
Shipping
- We
aim to deliver the Product to the delivery point you specified in your Order
and within the delivery time that we display when you checkout (updated in the
Order Confirmation).
- We
will notify you if we are unable to meet the expected delivery date, but, to
the extent permitted by law, we will not be liable to you for any loss,
liability, cost of damage or other costs arising from such delay.
- When
the Product is shipped you may be asked to sign a proof of delivery. You can
contact 2TANG Customer Service at customer@2tang.com in the event of an error,
defect or damage. You must be able to present the documents shipped with the
Product, upon request.
- Please
note that we may not be able to make deliveries to certain areas. We will
inform you via the contact address you provided to us when you placed your
Order and arrange for cancellation of the Order or delivery to an alternative
delivery address.
- We
ship Products in our standard packaging.
- All
risk in the Products will pass to you upon delivery unless delivery is delayed
due to your breach of obligations under the Contract (see 7.8 below), and in
such circumstances the risk will pass not to the date on which delivery would
have occurred but to the time of your breach. When the risk passes to you we
are not responsible for any loss or damage to the Product. Any breach of
obligations by you may affect your ability to shop at 2Tang in the future.
- If
you are unable to pick up or accept delivery, we may leave a card with
instructions regarding re-delivery or collection of the item from the sending
courier.
- If
delivery or collection is delayed due to your unreasonable refusal to accept
delivery, or if you do not decide not to accept delivery of the Product from
the courier (within one week of our first attempt to deliver the Product to
you), we may (without affecting the others available to us) do one or both of
the following:
- charge
us for any fees or other fees we reasonably incur; or
- determines
that the Product is no longer available for delivery or collection and notifies
you that we will immediately cancel the applicable Contract, in which case we
will refund to you the payment you have made under the Contract minus any
administrative fees (including the cost of attempting to ship and return the
Product). and any storage costs that may exist as set out in clause 7.8(a)
above).
- You
acknowledge that the Products are standard and not tailor-made to meet your
requirements.
11.
Cancellation By Customer (Undamaged Product)
If
you wish to cancel your order please contact 2TANG TEA Customer Service at
customer@2tang.com. Cancellation fee does not apply. Packaged orders cannot be
canceled and the item needs to be returned to us according to the guidelines
provided by our Customer Service Team (please call the number above or see the
return slip included in the package received).
12.
Returns and Refund Policy
- If
you are not satisfied with your purchase, you may return the Product to us
within thirty (30) days of receipt. Products must be unused, undamaged product
tags and in original brand packaging (if any). This policy only applies to
products that are not on the list of brands/non-refundable items found on our
Platform.
- The
product must have been received by 2TANG TEA before a refund or replacement can
be made. You need to ensure that the Products we receive are in the same
condition as when you received them and are well packaged. If the item is
returned to us in an unsuitable condition we reserve the right to refuse the return
and resend the Product to you.
- We
do not accept returns made in person.
- Product
returns along with return slips are normally received at our warehouse location
within 5 (five) working days after the goods are dropped off or picked up. Our
Quality Check team may take 2 (two) to 4 (four) business days to process your
return. The time it takes to process returns may vary depending on the return
method chosen, location, delivery date and courier speed. Refunds will be made
as soon as we receive the goods and according to the refund method stated on
your return slip.
13.
Broken Product
- All
Product descriptions, information and materials posted on this Platform are
provided 'as is' and without warranty either direct, implied or of any kind.
- Product
Images as seen on the Product may have slight differences from the actual
Product you receive.
- If
the item you receive is defective, please contact our Customer Service Team and
provide your Order number, name and address, product details and reason for
return, and whether you are requesting a refund or replacement product.
- After
the Product is returned we will do an inspection and inform the status of the
replacement or refund (if any) to you via email as soon as possible.
- 2TANG
TEA at its sole discretion may refuse to process a replacement or exchange
Order and offer a refund
- If
no damage to the Product is returned, we have the discretion to decide not to
replace the Product or refund and/or we may ask you to pay all reasonable
shipping and service fees in accordance with our current standard fees and
other fees to the card. your debut or any other payment information you provide
at the time you place an Order, and to the extent permitted by law, we are not
liable to you for any loss, liability, cost of damages or other costs.
14.
Vouchers
- You
can use promotional vouchers and e-gift cards when paying for Product purchases
on the Platform. Specific details for promotional vouchers and e-gift cards are
listed below.
- To
redeem vouchers in your Account or to check existing credit, please visit
"User Accounts" on our Platform. In accordance with clause 14.1, we
are not responsible for errors in the voucher recipient's email address.
- Vouchers
need to be entered on the online check out page. Handing over vouchers directly
to the 2TANG TEA dispatcher/team cannot be accepted.
- If
there is fraud or if there is an alleged illegal act related to purchasing
e-gift cards or redeeming vouchers on the Platform, we reserve the right to
close your account and/or request a different means of payment.
- We
are not responsible for the loss, loss, theft or unauthorized e-git card or
voucher.
- In
rare cases, 2TANG TEA may at its sole discretion terminate or cancel any
previously issued vouchers and shall not be liable for any losses arising
therefrom.
- Conditions
for redemption of promotional vouchers:
- From
time to time we may be able to distribute promotional vouchers that can only be
used on the Platform which we will send to you by email or post:
- Promotional
vouchers are valid for a certain period of time stated on the voucher, can only
be redeemed once and cannot be used in conjunction with other promotional
vouchers or for discounted items. We may exclude the use of promotional
vouchers for certain brands in accordance with our sales strategy. The current

- You
can only redeem ONE voucher for each promotional campaign. 2TANG TEA reserves
the right to cancel any subsequent orders that you place using a voucher code
for the same promotional campaign.(c) If the value of the Product in the Order
is lower find the value of the promotional voucher, the difference will not be
refunded to you.
- Promotional
voucher credits are interest-free and have no cash value.
- If
the promotional voucher credit is not sufficient for your Order, you may pay
for the shortfall through any of the payment methods we accept.
- For
vouchers with a predetermined cash value, if you decide to return the Product,
the amount returned is not the same as the cash value stated on the voucher.
However, if you pay part of it with your own funds, this portion will be returned.
15.
Compensation
You
agree to indemnify, defend and hold harmless 2TANG TEA, its directors,
officers, employees, consultants, agents and affiliates, from any and all third
party claims, liabilities, damages and/or costs (including but not limited to,
legal fees) arising from your use of this Platform or your breach of these
Terms and Conditions.
16.
Guarantee and Complaint Method
2TANG
TEA will carry out its obligations under these Terms and Conditions in
accordance with its ability and reasonable care.
Customer
satisfaction is our priority. You can contact us at any time through the
contact address of these Terms and Conditions. We will endeavor to resolve your
concerns and will contact you as soon as possible. Complaints about product
warranties will take longer to resolve as resolution may involve the role of
the manufacturer or supplier.
In
submitting a complaint, it will be very helpful if you can explain your
complaint clearly and accurately, and if possible please also provide us with a
copy of the Order or at least your Order Number as stated in the Order
Confirmation. In rare cases your email may enter our spam filter or we may not
receive it, or the correspondence we send to you may not be received by you
otherwise. If you do not receive a response from us within five (5) Business
Days, please contact us again.
17.
Protection of Personal Data
Please
see our Privacy Policy, which forms part of these Terms and Conditions.
18.
Notice
Any
notice under the Contract will be given in writing either by letter or email to
the party concerned at the last known address or email address.
- Notice
given by post will be deemed to have been given within two (2) Business Days
delivered to the recipient's address in Indonesia.
- Any
notice given by email is deemed to have been given within two (2) Days of the
email being sent.
- This
situation can be proven by showing that the letter or email has been sent to
the correct address and sent by post or by registered post or through existing
proof of delivery.
19.
Ads On Site
- We
will make every effort to comply with any relevant regulations relating to this
Platform. You can link to our front page as long as the link is done legally
and does not damage our reputation or is not for profit-seeking purposes, but
you are prohibited from creating a link in a way that suggests we have an
association or give you any approval or endorsement of any kind.
- You
are prohibited from linking from any Platform that is not your own. This
Platform cannot be used in conjunction with other platforms, and you are
prohibited from linking to any part of the Platform other than the home page.
We reserve the right to remove link permissions without prior notice.
20.
Liberation
Failure
or delay in exercising our rights under these Terms of Use or in accordance
with the Contract shall not be deemed a waiver of such rights or their
extension or affect the rights and remedies associated with it or be deemed to
change or remove our rights or your rights under these Terms and Conditions or
in Contract.
21.
Termination
If
any article in the Terms and Conditions or the Contract becomes or is declared
by a court of competent jurisdiction to be invalid or unenforceable, invalid or
invalid, then that article does not affect the provisions of the article or
other parts, all of which will remain in full force and effect as long as the
Terms and Conditions or The contract can continue to be valid indefinitely.

Diversion
You
may not assign, transfer, novate, collect, sub-contract, create obligations or

Relationship

and Conditions or Contracts shall not be construed as a partnership, agency or
employer-employee relationship between you and us.

Third Party Rights
Anyone
who is not a party to the Terms and Conditions or in no rights to them or is
not entitled to benefit from such provisions even if that person relies on or
refers to or agrees to any part of the Terms and Conditions or the Contract.
25.
Applicable Law
The
Terms and Conditions and Contracts (and all non-contractual obligations arising
out of or relating to them) are governed and construed in accordance with
Indonesian law. Both we and you hereby submit to the non-exclusive jurisdiction
of the Indonesian Courts. All transactions, correspondence and contacts between
us must be made or conducted in the Indonesian language.
26.
Variations
From
time to time 2TANG may make changes and/or updates to these Terms and
Conditions. Any changes and/or updates will be displayed on the Terms and
Conditions page on the Platform to be effective immediately. We recommend that
you check the Terms and Conditions page periodically for any changes. By
continuing to access and use our Platform, you are deemed to have accepted and
agreed to changes and/or updates to these Terms and Conditions.
